Welcome to NEX (“NEX,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the NEX website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using NEX, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

1. About NEX

NEX is an online job board that connects employers with job seekers. NEX provides a platform where employers may post employment opportunities and job seekers may search, apply, and communicate regarding employment opportunities.

NEX is not an employer, employment agency, staffing agency, recruiter, or hiring company unless explicitly stated. NEX does not guarantee employment, interviews, job offers, or successful hiring outcomes.

2. Eligibility

You must be at least eighteen (18) years old or the legal age of majority in your jurisdiction to create an account and use the Platform.

By using NEX, you represent and warrant that:

  • You have the legal capacity to enter into these Terms.
  • All information you provide is accurate and truthful.
  • You will comply with all applicable laws and regulations.

3. User Accounts

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information.
  • Keep your account information current.
  • Maintain the confidentiality of your login credentials.
  • Notify NEX immediately of any unauthorized use of your account.

You are solely responsible for all activity occurring under your account.

4. Job Seeker Responsibilities

As a job seeker, you agree to:

  • Provide truthful resumes, qualifications, certifications, and employment history.
  • Submit applications only for positions you are genuinely interested in.
  • Communicate professionally with employers.
  • Keep your profile information accurate and current.

You understand that employers make their own hiring decisions, and NEX has no control over those decisions.

5. Employer Responsibilities

Employers using NEX agree to:

  • Post only legitimate employment opportunities.
  • Provide accurate job descriptions.
  • Comply with all federal, state, and local employment laws.
  • Avoid discriminatory hiring practices.
  • Maintain confidentiality of applicant information.
  • Use applicant information solely for recruitment purposes.

Employers may not post fraudulent, misleading, deceptive, or unlawful job listings.

6. Prohibited Conduct

Users may not:

  • Provide false information.
  • Impersonate another person or business.
  • Post fraudulent jobs.
  • Use automated bots without authorization.
  • Attempt to interfere with the operation of the Platform.
  • Upload viruses or malicious software.
  • Harvest user information.
  • Spam other users.
  • Circumvent Platform security.
  • Violate applicable laws.

NEX reserves the right to suspend or permanently remove accounts engaging in prohibited conduct.

7. Job Listings

NEX does not verify every job listing or employer.

While we strive to maintain a trustworthy marketplace, we cannot guarantee that:

  • every job posting is accurate;
  • every employer is legitimate;
  • every applicant is qualified; or
  • employment opportunities remain available.

Users should conduct their own due diligence before accepting employment or sharing sensitive personal information.

8. No Employment Guarantee

NEX makes no guarantees regarding:

  • interviews,
  • employment offers,
  • salary,
  • compensation,
  • employment duration,
  • employer responses, or
  • hiring outcomes.

Using NEX does not guarantee employment.

9. User Content

Users retain ownership of the resumes, profiles, photographs, documents, job postings, and other content they upload.

By submitting content, you grant NEX a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and use such content solely for operating, promoting, and improving the Platform.

You represent that you own or have permission to use all submitted content.

10. Privacy

Your use of NEX is also governed by our Privacy Policy.

By using the Platform, you consent to the collection, storage, and processing of information as described in the Privacy Policy.

11. Communications

By creating an account, you agree to receive communications from NEX, including:

  • account notifications;
  • application updates;
  • employer messages;
  • security notices;
  • customer support communications; and
  • service announcements.

You may opt out of promotional emails at any time, but you may continue to receive essential service-related communications.

12. Fees

Creating a job seeker account is generally free unless otherwise stated.

Employers may be charged fees for premium services, featured job listings, subscriptions, advertising, or other paid features.

All fees are non-refundable unless otherwise required by law or stated in writing.

13. Intellectual Property

The Platform, including its design, software, trademarks, logos, graphics, and content, is owned by NEX or its licensors.

You may not copy, reproduce, modify, distribute, or create derivative works without prior written permission.

“NEX” and related logos are trademarks of NEX.

14. Third-Party Services

The Platform may contain links to third-party websites or services.

NEX does not endorse or control third-party content and is not responsible for their products, services, privacy practices, or business activities.

Your interactions with third parties are solely between you and those parties.

15. Disclaimer of Warranties

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, NEX disclaims all warranties, including but not limited to:

  • merchantability;
  • fitness for a particular purpose;
  • non-infringement;
  • uninterrupted availability; and
  • accuracy of information.

NEX does not warrant that the Platform will be error-free, secure, or continuously available.

16. Limitation of Liability

To the maximum extent permitted by law, NEX, its officers, directors, employees, affiliates, licensors, and partners shall not be liable for:

  • lost profits;
  • lost employment opportunities;
  • business interruption;
  • data loss;
  • indirect damages;
  • incidental damages;
  • consequential damages; or
  • punitive damages arising from use of the Platform.

Your sole remedy for dissatisfaction with the Platform is to discontinue using it.

17. Indemnification

You agree to indemnify, defend, and hold harmless NEX, its affiliates, officers, employees, contractors, and agents from any claims, damages, liabilities, costs, and expenses arising out of:

  • your use of the Platform;
  • your violation of these Terms;
  • your violation of applicable law; or
  • your infringement of another person’s rights.

18. Account Suspension and Termination

NEX may suspend or terminate any account, without notice, if we believe the user:

  • violated these Terms;
  • engaged in fraudulent activity;
  • posted illegal content;
  • abused other users; or
  • created a security risk.

Users may delete their accounts at any time through their account settings or by contacting customer support.

19. Modifications to the Platform

NEX reserves the right to modify, suspend, discontinue, or update any feature of the Platform at any time without liability.

20. Changes to These Terms

We may revise these Terms periodically.

Updated Terms become effective upon posting on the Platform.

Your continued use of NEX after updates constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal action relating to these Terms shall be brought exclusively in the state or federal courts located in Florida.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms constitute the entire agreement between you and NEX regarding your use of the Platform and supersede all prior agreements relating to the Platform.
